These Terms of Service ("Terms") govern access to and use of websites, software, publishing tools, integrations, and related services provided by PageSparx, Inc. ("PageSparx," "we," "us," or "our"). By using a PageSparx service, authorizing a PageSparx application, or asking PageSparx to perform services on your behalf, you agree to these Terms.
If you have a separate written agreement with PageSparx, that agreement controls to the extent it conflicts with these Terms.
PageSparx provides website, digital marketing, publishing, design, development, advertising, and related technology services for businesses. Individual products and client engagements may include different features, limitations, fees, service levels, and responsibilities.
You may connect PageSparx services to third-party business accounts, Pages, professional profiles, websites, or other destinations that you are authorized to manage. You represent that you have the rights and permissions necessary to authorize PageSparx to access and act on those destinations.
You are responsible for reviewing the destinations, permissions, content, media, timing, and other settings that you approve. PageSparx may refuse or suspend an action when authorization cannot be verified, a destination falls outside an approved account boundary, a platform rejects the request, or the action could violate law, platform rules, security requirements, or these Terms.
PageSparx tools may help create, edit, schedule, publish, update, or remove content on websites and third-party platforms. You remain responsible for reviewing and approving content before publication and for ensuring that content is accurate, lawful, appropriately licensed, and suitable for the intended audience.
Some PageSparx features may use artificial intelligence or automated systems to assist with drafting, images, metadata, scheduling, or other tasks. Automated output can contain errors. You are responsible for appropriate human review before relying on or publishing such output.
Facebook, Instagram, Google, X, and other third-party platforms are independent services. Their availability, APIs, permissions, review requirements, pricing, rate limits, functionality, and policies may change without notice. Your use of those services is also subject to their respective terms and policies.
PageSparx is not responsible for outages, rejected posts, suspended accounts, changed API behavior, loss of third-party functionality, or other actions controlled by a third-party platform, although we may provide reasonable technical support for integrations we offer.
You are responsible for protecting credentials and maintaining appropriate access controls for your accounts. Notify PageSparx promptly if you believe an account, token, credential, or connected service has been compromised or used without authorization.
You may not use PageSparx services to violate law, infringe another person's rights, gain unauthorized access to accounts or systems, distribute malicious software, misrepresent your authority to manage an account, bypass platform restrictions, or engage in activity that materially interferes with the security or operation of our services.
Unless a separate written agreement states otherwise, PageSparx retains ownership of its software, systems, methods, source code, internal tools, designs, templates, and proprietary technology. You retain rights you already hold in content, trademarks, media, and other materials that you provide to us.
We may update, modify, suspend, or discontinue features when reasonably necessary for security, maintenance, legal compliance, third-party platform changes, product development, or other business reasons. We may also impose reasonable technical limits to protect service reliability and security.
Marketing, search visibility, social engagement, advertising performance, audience response, lead generation, and other business outcomes depend on factors outside PageSparx's control. Unless expressly stated in a separate written agreement, PageSparx does not guarantee rankings, traffic, engagement, leads, revenue, or other specific results.
Except as expressly provided in a written agreement, PageSparx services are provided on an "as available" basis. To the fullest extent permitted by law, PageSparx disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, and noninfringement.
To the fullest extent permitted by law, PageSparx will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption arising from use of the services or a third-party platform. Any limitations contained in a separate written agreement with you will control where applicable.
You may stop using a PageSparx service or revoke a third-party authorization at any time, subject to any separate client agreement. PageSparx may suspend or terminate access when reasonably necessary to address nonpayment, security risk, unlawful activity, misuse, platform-policy violations, or material breach of an applicable agreement.

We may update these Terms from time to time. The "Last updated" date above identifies the current version. Continued use of the services after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
